Spokn Privacy Policy

Podio.xyz, Inc. (“Spokn,” “we,” “us,” “our”) takes your privacy and the protection of your personal data very seriously.  The purpose of this Privacy Policy (“Policy”) is to explain the essential details of how we collect, use, and protect your personal information. The terms governing your use of the Spokn mobile application are outlined in our Terms of Use. In the case that any new services offered by Spokn cause changes in how we collect, use, or protect your personal data, then we will update this Privacy Policy with additional information or policies.

This Policy covers the Spokn service, including its mobile application, website, and any other applications or websites produced by Spokn. We are not responsible for the privacy practices of any third-party websites or services that you may be linked to through the use of the Spokn service.

Your rights

You have certain rights regarding your personal data that is held by Spokn. In particular, you the right to:

• Withdraw your consent. At any time, you can change your mind and withdraw your consent to us processing some or all of your data. In some cases, this may mean we have to delete your account.
• Access or rectify your data. You can access a copy of the data that Spokn holds on you, and you can rectify inaccurate data.
• Restrict the processing of your data. You can ask us to restrict our use of your data, such as but not limited to where the data is out of date.
• Delete your personal data. You can delete your personal data by deleting your account. In some cases, you can ask us to erase some of your data.

How to exercise these rights

Any requests to exercise user rights can be directed to Spokn through the contact details provided in this document. These requests can be exercised free of charge and, upon verification of your identity, will be addressed by Spokn as early as possible and always within a reasonable timeframe.

Legal action

Your personal data may be used by Spokn during possible legal action resulting from improper use of the Spokn application or services. We will only share your personal data when we in good faith believe it is necessary for us to do so in order to comply with a legal obligation and when your fundamental rights and freedoms are not at risk. Necessary circumstances include, but are not limited to, national security, law enforcement, litigation, criminal investigation, protecting the safety of any person, or to prevent death or imminent bodily harm.

What personal data we collect

Personal data can be freely provided by you or be collected automatically when you use the Spokn application. We collect your personal data in these ways:

When you sign up for Spokn: We collect personal data such as but not limited to: your email address, name, gender, and country.

Through your use of the Spokn application: We collect usage data about your use of the Spokn service, such as but not limited to which topics and publishers you follow and what articles you listen to.

From third parties: We work with partners that may provide us with additional data about you and your activity. If you have provided your consent to the third party or to Spokn, and if Spokn has a legitimate interest in using this personal data, then we will use this data to provide you with the Spokn service.

Account registration data

Account registration data is the personal data that is provided by you or collected by us to enable you to sign up for and use the Spokn service. Some of the personal data we will ask you to provide, such as but not limited to your name and email address, is required in order to create your account. You also have the option to provide us with some additional personal data, such as but not limited to your birthdate, in order to make your account more personalized.

The exact personal data we will collect depends on whether or not you use a third-party service such as but not limited to Facebook or LinkedIn to sign up for the Spokn service. If you use a third-party service to create an account and you consent to that service sharing your data with us, then we will receive personal data via that service.

Usage data

We collect usage data for the purpose of providing the Spokn service. Usage data is the personal data that is collected about you when you are using the Spokn service. This can include:

• Your interactions with the Spokn service such as but not limited to: your navigation activity, articles you listen to, playlists you create, likes, downloads, saves, and session duration.
• Log data which may include cookie data (files with a small amount of data that are commonly used as anonymous unique identifiers), the types of devices you are using to access the Spokn application, installation source, your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing the Spokn service, and the time and date of your use of the service. Log data is collected for operation and maintenance purposes.
• Your interactions with Spokn customer service.
• We may also collect the following types of data, including but not limited to when we add new features and products to the Spokn service: data on your Spokn subscription plan, payment data, your contacts (with your explicit consent), photos from your mobile device (with your explicit consent), GPS device location to enable location-based functions (with your explicit consent), and voice data to enable voice-activated commands.

As with all personal data we collect, you always have the right to withdraw your consent.

How we use personal data

We process this personal data for these reasons:

• To provide and personalize your experience with the Spokn service;
• To ensure technical functionality of the Spokn service and develop new features and services;
• To facilitate analysis of how the Spokn service is used,
• To communicate with you about the Spokn service, and for marketing, research, and promotional purposes via emails, notifications, or other messages according to your permissions.

Service providers

We use technical service providers to run the technical infrastructure for the Spokn service, including hosting, storing, management, and maintenance of the Spokn application, its content, and the data we process. We also use third-party service providers to collect usage data and for marketing, research, and promotional purposes. We may also partner with advertising providers to offer third-party advertisements. These service providers have access to your personal data, but they are under a strict obligation not to disclose or use your data for any other purposes than the Spokn service.

Legal basis for data processing

Spokn may process users’ personal data if one of the following applies:

• Users have given their consent for one or more specific purposes. Under some legislations Spokn may be allowed to process personal data until the user objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of personal data is subject to European data protection law;

• Processing is necessary for compliance with a legal obligation to which Spokn is subject;
• Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in Spokn;
• Processing is necessary for the purposes of the legitimate interests pursued by Spokn or by a third party.

How we keep personal data safe

Spokn is committed to the safety and protection of your personal data. We take security measures to prevent unauthorized access, disclosure, modification, or destruction of personal data. Personal data is processed using computers and/or IT-enabled tools, following procedures and protocols for safety purposes. In addition to Spokn staff, in some cases, the personal data may be accessible to persons involved with the administration, sales, marketing, legal, system administration or other third-party technical services with Spokn’s permission. You may request an updated list of parties that have access to your personal data at any time.

No data system can be entirely secure. Your account and personal data are protected by your password, so we ask that you keep your password and devices as secure as possible.

Place

Personal data is processed at Spokn’s operating offices and in other places where the persons involved in the processing are located. Data transfers may involve transferring your personal data to a country other than your own. You are entitled to learn about the security measures taken by Spokn to safeguard your data.

Data retention and deletion

We store your personal data only for the time that it is necessary for the purpose it was collected for and/ or to comply with legal obligations and/or for dispute resolution. At your request, we will delete or anonymize your personal data except for cases where maintaining certain personal data is necessary for our legal obligations or legitimate interests such as but not limited to fraud prevention and security. We may retain your personal data for a longer period as long as you have given or not withdrawn your consent.

We will delete your personal data once the circumstances above no longer apply. After this period expires and your data is deleted, you can no longer enforce your rights to access, rectify, or receive your data.

The Spokn service may provide content that links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. Before clicking on a third-party link, please note that you are leaving the Spokn service and any personal data you provide will not be covered by Spokn’s Policy. Therefore, we strongly advise you to review the Privacy Policy of these websites or services.

Purchase of the Spokn business

We may share your personal data in cases where we sell or negotiate to sell Spokn to a buyer or prospective buyer. In these cases, Spokn will still ensure that your personal data is kept confidential. We will always give you notice before your personal data is transferred to a buyer or becomes subject to a different Privacy Policy.

Children

We do not knowingly collect personal data from children under 13 years old or under the applicable age limit. If we learn that we have collected the personal data of a child under the age limit, we will take reasonable steps to delete this personal data.
